Mediation
Mediation is a voluntary process in which a neutral third party — the mediator — helps the parties reach a mutually acceptable agreement. Unlike litigation, the decision stays with the parties, and the resulting settlement is tailored precisely to their needs.
What is mediation?
A mediator does not decide who is right. The role is to guide a structured conversation, surface each side’s underlying interests, and help craft an agreed solution. Once the parties agree, the settlement can be given the force of a court judgment.
When is mediation the right choice?
- When preserving the relationship matters (business partners, family members, neighbours).
- When a fast, cost-effective resolution is preferred over litigation.
- When confidentiality is essential — mediation is private.
- When the parties want control over the outcome rather than leaving it to a judge.
Advantages of mediation
- Speed — often just a few sessions.
- Cost savings in both money and time.
- Confidentiality — what is said is not admissible in court.
- Flexibility — creative solutions a court judgment cannot provide.
