Commercial Dispute Resolution in Israel
A commercial dispute can delay a transaction, disrupt a company, damage an important business relationship or consume substantial management attention.
Mediation and arbitration provide structured ways to address business disputes outside the ordinary course of court litigation. The appropriate process depends on the nature of the dispute, the relationship between the parties, the need for a binding determination and the practical business objectives.
I work with companies, business owners, partners, founders, shareholders, suppliers and customers in commercial disputes, including matters involving overseas counterparties and English-language agreements.

Commercial mediation
Mediation can be useful where the parties want to explore an agreed solution rather than transfer control of the outcome to a decision-maker.
The discussion can address issues that may not fit neatly into a legal claim, including revised commercial terms, payment arrangements, transition periods, transfer of customers or assets, continued cooperation, exit arrangements and allocation of future responsibilities.
The mediator does not decide who is right. The role is to manage the process and help the parties test whether an acceptable agreement is possible.
Commercial arbitration
Where the parties need a binding determination, arbitration may provide a suitable forum depending on the arbitration agreement, applicable law and circumstances.
In appropriate cases, the parties can agree a focused procedural framework that reflects the complexity of the dispute. This can be particularly valuable where the issues are commercial, technical or document-heavy.
What should be considered before choosing a process?
Useful questions include:
- Can the parties still make a negotiated decision together?
- Is there a business relationship worth preserving or ending in an orderly way?
- Is a binding determination required?
- Does the contract contain a mediation or arbitration clause?
- Is there a significant technical or industry-specific component?
- Does the solution need to address more than money?
- What happens to the business while the dispute continues?
- Are decision-makers or relevant parties located outside Israel?
There is no single process that fits every dispute.
Cross-border commercial disputes
Where a dispute involves an Israeli company and an overseas counterparty, practical issues can include language, travel, time zones, foreign counsel, governing law, jurisdiction and enforcement.
Mediation or arbitration can often be conducted in English and, where appropriate, remotely. The legal framework should be considered case by case.
Commercial understanding matters
A legal outcome that ignores the commercial reality may solve only part of the problem.
My legal and executive background helps me look at the dispute through the issues that matter in practice: cost, continuity, customers, reputation, management resources, operational risk and the ability to implement the eventual agreement or determination.
In technology, cyber and privacy disputes, that is combined with direct professional familiarity with the subject matter.
Want to discuss the right process for your dispute?
A short initial enquiry with the names of the parties and a brief description is enough to start.
